Nathan Fish has extensive experience navigating the complex landscape of state and federal laws governing the healthcare and life sciences industries. He is intimately familiar with the federal anti-kickback statute and Stark law, similar state anti-kickback and self-referral laws, Medicare and Medicaid program requirements, state professional and facility licensing requirements, the corporate practice of medicine doctrine and fee-splitting laws, transparency reporting requirements, privacy laws, and other state and federal laws that impact healthcare and life sciences businesses. Nathan also advises clients on billing rules and regulations, including rules relating to “incident to” billing, modifier use, out-of-network billing, and billing by specific types of providers and suppliers (such as IDTFs, DMEPOS suppliers, laboratories, and physician practices).
His regulatory background includes representation of hospitals, skilled nursing facilities, physicians and group practices, telemedicine providers, DMEPOS suppliers, IDTFs, laboratories, home health agencies, pharmacies, fertility clinics, GPOs, drug and device manufacturers and suppliers, and other healthcare and life sciences companies. Nathan regularly handles complex matters and provides practical, real-word advice that clients can implement in their day-to-day operations.

Nathan Fish has a broad range of experience advising clients on mergers and acquisitions and providing general corporate advice in the healthcare and life sciences industries. His transactional background includes representation of hospitals, pharmacies, IDTFs, DMEPOS suppliers, home health agencies and hospices, device manufacturers, physician and dental practices, skilled nursing facilities, ambulatory surgery centers, and other healthcare and life sciences businesses in acquisitions, sales, and other transactions – large and small. Nathan has significant experience conducting regulatory and corporate due diligence review and structural analysis, assisting with required pre-closing and post-closing regulatory filings, negotiation, and drafting of necessary transaction documents. He also assists private equity and growth investors and their portfolio companies with a range of corporate and transactional issues, including acquisitions, equity investments, disposals, employment matters, management incentivization, and corporate restructurings.
Audits, Investigations, & Compliance
Nathan Fish represents physicians, chiropractors, podiatrists, dentists, nurses, medical groups, clinics, DMEPOS suppliers, skilled nursing facilities, and other healthcare providers and suppliers dealing with Medicare revocation, Medicaid enforcement actions, payor audits and investigations, and in defending individual and facility licensing actions. His background includes assisting clients with internal investigations, voluntary self-disclosures, government inquiries and subpoenas, payor and government audits, investigations, and appeals of deficiencies, citations, and other adverse actions. He also assists with developing, implementing, and enhancing corporate compliance programs, and provides hand-on support to his clients, such as in-person and virtual compliance training for board members, senior executives, managers, and employees. Nathan has also served as outside general counsel and compliance officer to healthcare and life sciences entities.
